Arden Holdings Inc., Ardene International Inc. and/or their affiliates (collectively, “Ardene”, “us”, “we”, or “our”) take privacy and data security seriously. We are committed to transparency in the collection, use, and disclosure of your Personal Information. This privacy policy describes:
- How we collect, use, disclose, and protect the personal information of our customers who visit our stores or use our website and/ or Ardene mobile app (”you”).
- The types of information we may collect from you when you visit our stores or that you may provide when you visit the website https://www.ardene.com (our “Website”) or when you use our mobile app: the Ardene App (our “App”) (collectively, the “Sites”).
- Our practices for collecting, using, maintaining, protecting, sharing, and disclosing that information.
In this policy personal information is defined as any information that we can reasonably use to directly or indirectly identify you, such as your name, mailing address, e-mail address, telephone number, Internet protocol (IP) address used to connect your computer to the Internet, user name or other similar identifier, billing and account information, and any other information as described in Section 2 of this policy (”Personal Information”).
We will only use your personal information in accordance with this privacy policy unless otherwise required by applicable law. We take steps to ensure that the Personal Information that we collect about you is adequate, relevant, not excessive, and used for limited purposes.
This policy may change from time to time (see Updates to this privacy policy section). Your continued use of our Sites after we make changes indicates that you accept and consent to those changes, so please check the policy periodically for updates.
PERSONAL INFORMATION OF MINORS
We encourage parents and guardians to supervise their children’s use of the internet, including our Sites.
We do not knowingly collect any Personal Information from children under the age of 14. Children under the age of 14 should not use the Sites or provide us with any Personal Information without the consent and supervision of their authorized guardian.

We collect personal information for the following purposes:
- to improve your shopping experience;
- to communicate with you about our products;
- to administer promotions or contests;
- to protect you and us from error and fraud;
- to process your submissions;
- to keep track of transactions and to comply with legal and governmental requirements;

- to send you notifications, with your consent; we may deliver notifications to your mobile device (within or outside the App) about collection drops, promos and flash sales. - to conduct surveys and analyses for research, statistical and product design and development purposes, or to achieve any other purposes as may be permitted by law from time to time.
How do we use your Personal Information?
The Personal Information we collect from you may be used in any of the following ways:
- to personalize your experience on our Sites: your information helps us to better respond to your individual needs;
- to administer your Ardene Rewards, such as saving items in your wish list and enabling you to check out faster;
- to improve our Sites: we continually strive to improve our Sites offerings based on the information and feedback we receive from visitors like you;
- to improve customer service: Personal Information helps us to more effectively respond to customer service requests and support needs;
- to process transactions;
- to administer contests, promotions, surveys or other Site features including recruitment and employment matters;
- to send periodic marketing emails, text messages or push notifications (you can unsubscribe any time by following the instructions under “Your Choices” in Section 7);
- to create aggregate information; and
- as otherwise described in this privacy policy.
You may withdraw your consent to the processing of your Personal Information for any of the above purposes by contacting our Data Privacy Officer whose contact information is set out in Section 8. Please note, however, that withdrawing your consent to the processing of your Personal Information may impede our ability, under certain conditions, to provide products to you.
- What kind of personal information do we collect?
We limit our collection of your personal information to what is necessary to accomplish the purposes outlined above. Examples of such Personal Information includes:
- Contact information:This includes your first and last name, email address, billing and shipping addresses, and telephone number. We collect this information when you purchase products or services from us, contact us through customer service, or create an online account with us.
- Payment and transaction information:We collect information necessary to place your orders through our Sites, including your name, credit card information, bank account number, and billing and shipping information and your purchase history.
- Profile information:We may collect information such as your age, date of birth, gender, biographical data, photos, interests, preferences, and information about your participation in our events, promotions, contests, or surveys. We also collect the username and password you create to establish an online account with us.
- Communications:We may collect information from communications that we exchange or that you transmit or post, including when you send us questions, comments, or other information through customer service or on social media. We may record our conversations, including our telephone conversations.
- Research information:If you agree to participate in our surveys or research activities, we may collect information such as your survey responses, and audio or video recordings related to these surveys and research activities.
- Marketing information:We collect information about your preferences for receiving communications about our products, services, events, promotions, and newsletters. We may also collect settings, IP addresses, operating system, and browser information.
- Device-related information:We collect information about your device-related information, such as the make and model of your device, its operating system, mobile device identification number (IMEI), MAC address, device identifiers (e.g. AAID, IDFA), information about the screen size, and the date and time of your use.
- Location data:We collect precise or approximate location information in accordance with the permissions enabled on your mobile device. You may access and use our mobile app without permitting the collection of location data; however, certain features or functionalities may become limited or unavailable.
- How do we collect your personal information?
We collect information directly from you when you make a purchase at one of our retail stores, and when you visit our Sites, sign up for an account on our Sites, create a Wishlist, join Ardene Rewards, make a purchase or place an order, sign up to receive our marketing emails, respond to a survey, fill out a form, contact us, enter contests or other promotional opportunities, make inquiries, as well as other lawful means. We may also collect your Personal Information from third parties to whom you have provided same, such as financial institutions and social networking websites or applications. The collection of Personal Information by Ardene will be limited to what is necessary for the purposes identified in this privacy policy.
HOW WE USE COOKIES
With your prior consent we and our third-party service providers or partners may use technologies, such as cookies and other tracking mechanisms (including tracking technologies designed for mobile applications), with identification, profiling, and localization functions to collect your Personal Information and track information about your use of our Sites. We may combine this information with other Personal Information we collect from you (and our third-party service providers may do so on our behalf). A technology has a profiling function when it can evaluate and analyze certain characteristics of a person, an identification function when it can distinguish one person from another, and a localization function when it can indicate where a person is at a given time. By opting not to activate these cookies you can decide that we do not use these cookies on your devices.
Cookies are small text files which embed themselves on your hard drive from some of the Sites’ pages. Cookies are harmless in the sense that they cannot extract any information from your hard drive, over which you have complete control. We and our third-party service providers use cookies to determine Site traffic, information about your devices and internet connection, including your IP address, operation system and browser type, convey useful information about your interests, and to personalize any future visits you make to the Sites. GOOGLE ANALYTICS AND THIRD-PARTY ANALYTICS
We may use a third party such as Google Analytics or Salesforce Einstein to help us gather and analyze information about the areas visited on the websites (such as the pages most read, time spent, search terms and other engagement data) in order to evaluate and improve the user experience and the convenience of the websites. Google Analytics may collect your IP address, data related to the device/browser you are using, and other information about your use of our Sites. Google Analytics provides us with statistical information about the use of our Sites. We use this information to understand our visitors and to improve the Sites. We cannot associate any of this information with any particular visitor. Our Sites may contain links to websites other than our own. Those websites may have their own privacy policy, or no privacy policy at all. These links are not intended as an endorsement of or referral to the linked websites. We are not responsible for those websites, and we provide these links solely for the convenience of visitors like you. These other websites may send their own cookies to you and may collect Personal Information and use it in a way inconsistent with this Privacy Policy. We encourage you to review the privacy policies and terms and conditions of use of any third-party websites or services before providing any of them with any of your Personal Information. Ardene does not control the content that appears on third-party websites and does not endorse or recommend such websites or their products or services. Accordingly, Ardene does not take any responsibility for their content.
- Who do we share your Personal Information with?
We do not sell, trade, or otherwise share or transfer your Personal Information to third parties. However, aggregate information, that does not identify any individual, may be provided to third parties for marketing, advertising, or other purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We may contract with Canadian, U.S. or other foreign third-party service providers to assist us in operating our Sites, conducting our business, better understanding our Sites visitors or otherwise provide services to Sites visitors, including performing such functions as fulfilling orders, delivering packages, processing credit card payments or providing customer service. These third-party service providers are not permitted to use the Personal Information except for the purposes described in this Privacy Policy. When we use third-party service providers, contractual provisions and other safeguards are used to ensure compliance by such third-party service providers with this Privacy Policy and all applicable privacy laws. Contractual provisions and other safeguards are also used to ensure that, where your Personal Information is transferred, processed or stored outside Canada, it is given protection similar to the protection set forth in this Privacy Policy.
You agree that persons or entities outside of Canada to which Personal Information is transferred may be required to disclose your Personal Information to governmental authorities, courts or law enforcement or regulatory agencies, pursuant to the laws of their jurisdiction. We may disclose Personal Information when we believe release is required in response to a search warrant or other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, enforce our Sites policies, protect the rights, property, or safety of Ardene or others, or as otherwise may be required or permitted by applicable Canadian, U.S. or other law or legal process, which may include lawful access by U.S. or foreign courts, law enforcement or other government authorities.
Your Personal Information may also be disclosed where necessary for the establishment, exercise or defence or legal claims and to investigate or prevent actual or suspected loss or harm to persons or property. We may disclose Personal Information to our subsidiaries and affiliates. We may disclose Personal Information, in accordance with applicable law, to a buyer or other successor in the event of an actual or prospective merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Ardene’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Ardene about our customers and users is among the assets transferred. Ardene will remain responsible at all times for Personal Information under its control.
Transferring your Personal Information outside of Quebec
Your Personal Information may be transferred to our service providers, mentioned above, outside of Quebec. We will conduct assessments to identify and mitigate against any risk to the protection of your Personal Information prior to transferring your Personal Information outside of the province.
- How do we protect your personal information?
Ardene protects Personal Information by implementing a variety of security safeguards appropriate to the sensitivity of the information, including through the use of the following measures: physical security measures, such as appropriate disposal of Personal Information; electronic/technical security measures, such as password protection and firewalls; and organizational/administrative processes such as limiting access to Personal Information to a selected group of persons on a “need to know” basis. No verbal or written disclosure of Personal Information or transmission of data containing Personal Information over the internet is guaranteed to be completely secure. It may be possible for third parties to overhear, see, intercept or access private communications or transmissions unlawfully. While we strive to protect your Personal Information, Ardene cannot ensure or warrant the security of any information you transmit to us in person or over the internet. Any such transmission is done at your own risk.
Ardene cannot be responsible for any Personal Information that you share publicly or post on our message boards, chat rooms or by way of other submissions to the public spaces of our stores or Sites. These are public areas and may be accessed, consulted or viewed by anyone.
- How long do we keep your personal information?
We will only retain your Personal Information for as long as is necessary to accomplish the purposes set out above or to meet our legal obligations.
- What are your rights and choices regarding your personal information?
Subject to applicable law and the jurisdiction in which you reside, you have many rights regarding your Personal Information that is in our custody and control, namely:
- The right to access your Personal Information and obtain a copy;
- The right to request that your Personal Information be shared with a third party;
- The right to correct and update your Personal Information that is inaccurate or out of date;
- The right to withdraw your consent to the processing of your Personal Information (please note that withdrawing your consent to the processing of your Personal Information may impede our ability to provide our products, under certain conditions, to you); and
- The right to request the deletion of your Personal Information that is obsolete or not justified to be held by the purposes of collection.

We may request Personal Information for the purpose of verifying the identity of the individual seeking to exercise their rights.
YOUR CHOICES
You can withdraw your consent to receive marketing emails from Ardene anytime by clicking on the “unsubscribe” link at the bottom of any of our marketing emails and following the unsubscribe instructions. You can also unsubscribe from text messages at any time by texting “STOP” to 39800. If you are an Ardene Rewards member you can also unsubscribe from promotions and text messages through the communication preference center on our website. You can turn off push notifications or our collection of location data through the Settings page on your mobile device. You can also opt-out by contacting our Data Privacy Officer us as set out in the section below. Please note that it might take a few days for all our systems to be updated, so you might get messages from us while we process your request, and you may continue to receive certain transactional or account-related email communications from us.
